VICTORIA
Victoria’s 2020-21 Business and Investor Visa nomination program (subclass 188 and 132) opened on 8 September 2020.
To help the state’s economic recovery and health response to the pandemic, the Commonwealth Department of Home Affairs has provided the Victorian Government with a short-term allocation of visa nomination places for the Business Innovation and Investment Program (BIIP). The limited number of BIIP places are only available until 6 October 2020.
The Federal Budget will outline what additional state nomination visa places will be allocated to the Victorian Government for the remainder of the 2020-21 program year.
Please note, to ensure that all applications received can be assessed within the timeframe, applications close at 5pm AEST, 21 September 2020.
Changes to nomination criteria
When applying for the BIIP program between 8 September 2020 and 21 September 2020 there is one additional requirement. All visa applications must demonstrate that the business and investment activity will contribute to Victoria’s economic recovery or health response.
The new requirement must be addressed in the ‘Economic Recovery – Business and Investment Support Form’.
To have the best chance of success, it is important that your application is specific about the ways your business or investment will assist Victoria’s economic recovery or health response to the pandemic.

NSW
On 31 August 2020 the New South Wales (NSW) Government provided an update on visas.
NSW has been provided a limited number of short-term nomination places for the 2020-21 financial year. As the nomination places are so limited, the NSW Government has made some temporary changes to the application process.
The visas affected are:
- Subclass 188 Business and Investor Visa
- Subclass 190 Skilled Migrant Visa
The changes to the application process will be reviewed if more nomination places are provided to NSW later in the financial year.
Business and Investor Visa
NSW will nominate potential business and investor applicants by invitation only.
To be considered for a nomination for the subclass 188 visa in NSW, please ensure that you have a valid Expression of Interest in SkillSelect and have selected NSW as your preferred state.
Skilled Migrant Visa
NSW has advised that invitation rounds will commence shortly for subclass 190 visa nominations. There are no set dates for invitation rounds.
In accordance with the directions from the Home Affairs department, NSW will only invite applicants in selected health, information and communications technology, and engineering occupations, who currently reside in NSW. For further information, please see our article outlining the updates to the Priority Migration Skilled Occupation List.
For all visa subclasses it is not necessary to submit a new Expression of Interest in SkillSelect if your current Expression of Interest is valid.
